Agreement to terms
These Terms of Service ("Terms") govern your use of Dialed, the web application and iOS app operated by Downsized B.V. ("we", "us", "our"), trading as Dialed. By creating an account or using Dialed, you agree to these Terms. If you do not agree, please do not use the service.
The service
Dialed is a platform for mountain bikers and their tuners. It lets you keep a digital garage of your bikes, record suspension and tyre setups per trail and condition, log and share service history, and connect with a community of riders, teams and shops. The same account works across the Dialed web application and the Dialed iOS app, which stay in sync.
We are building Dialed in early access. Features may change, and parts of the service may be added, adjusted or removed as the product develops.
Accounts
During early access, accounts are created by invitation. To use Dialed you must register an account and provide accurate, current information. You are responsible for keeping your login credentials safe and for everything that happens under your account. Tell us promptly at [email protected] if you suspect unauthorised use.
Acceptable use
You agree to use Dialed lawfully and respectfully. You may not:
- Upload content that is unlawful, infringing, abusive or misleading.
- Attempt to access accounts, data or systems that are not yours.
- Disrupt, overload or reverse engineer the service, or circumvent its security.
- Use the service to harass other riders, shops or teams.
We may suspend or remove content or accounts that breach these rules.
Your content and data
You own the content and data you put into Dialed: your bikes, setups, service notes, photos, posts and rider profile. Community content (such as posts, photos and public setups) is visible to others according to the privacy settings you choose on each item. By using the service, you grant us a limited licence to store, process and display your content within the platform for the sole purpose of operating Dialed and providing the features you use. We do not sell your content.
Paid access and billing
A free account includes one bike in your personal garage, with unlimited setups, trails and community features. Dialed Unlimited removes the one-bike limit and is currently sold as a one-off payment of EUR 25 for twelve months of access, including VAT.
Payments are processed by our payment provider, Mollie B.V. There is no automatic renewal and no payment mandate: you pay once, and no further charges follow. When your paid period ends, the account returns to the free tier and you can buy a new period from your profile page whenever you like.
Because nothing renews automatically, there is no subscription to cancel. We announce any price change at least 30 days in advance; it applies only to periods you buy after that.
Right of withdrawal and refunds
For your first purchase of Dialed Unlimited you have a 14-day right of withdrawal. Within those 14 days you can request a full refund by emailing [email protected]. Because the service starts immediately, you consent to that immediate start when you buy, while keeping your 14-day right on the first purchase.
Other refunds are handled case by case. A paid period that has started is not refunded for the remainder when you stop using the service, except where the law requires it.
Liability
Suspension setup data in Dialed is informational. Riding a mountain bike carries inherent risk, and you ride at your own risk. Setups, recommendations and community values are starting points, not professional advice; you are responsible for checking that your bike is safe and correctly set up before you ride. We are not liable for any setup outcome, mechanical issue, injury or loss arising from how you use the information in the service.
To the maximum extent permitted by law, our total liability for any claim relating to the service is limited to the fees you paid us in the 12 months before the claim. We are not liable for indirect or consequential loss.
Availability and support
We make reasonable efforts to keep Dialed available and working, but we do not guarantee uninterrupted or error-free service. For help, reach us at [email protected].
Intellectual property
Dialed, including its software, design, branding and the "Dialed" name, is owned by Downsized B.V. and protected by intellectual property law. These Terms do not transfer any of those rights to you. You keep all rights in your own content.
Termination
You can stop using Dialed and close your account at any time. We may suspend or terminate your access if you breach these Terms or use the service in a way that harms other users or us. On termination, the sections that by their nature should survive (such as content licence terms, liability and governing law) remain in effect.
Governing law
These Terms are governed by the law of the Netherlands. Any dispute that cannot be resolved amicably will be submitted to the competent court in Rotterdam, the Netherlands.
Changes to these terms
We may update these Terms as Dialed evolves. If we make a material change, we will give reasonable notice, for example by email or in the app. Continuing to use the service after a change takes effect means you accept the updated Terms.
